And it's hard to escape the irony of whining about modern civilization
getting in the way of his using a high powered hunting rifle. I'm
sure if he'd been holding a spear, he would not have endangered the
cruise ship.

Ooooh, Dennis pulls out the race card at the drop of a hat.

No, "native" Americans, like everyone else, are not supposed to whine
about the drawbacks of modern civilization while taking the benefits.
I found this particularly ironic from the article -- a guy who can't
use his high-powered rifle because of a cruise ship.

Not that it really matters -- "progress" will occur whether you like
it or not -- but I am guessing that this guy would rather have the
occasional cruise ship than give up his rifle.

Close, but no cigar. Dennis is 56 years old and has blue eyes. Also,
he is only 5'6" tall.

A judge has denied a Juneau man's request to open meetings between the
North West CruiseShip Association and city officials to the public.

The city is sending Assembly member Dale Anderson, city Port Director
Joe Graham, Docks and Harbors Board Chairman Loren Gerhard, city
engineer Joe Buck and Deputy City Manager Donna Pierce to Vancouver,
British Columbia, on Monday to meet with representatives of the
association.

Juneau resident Dennis Harris, who is not a lawyer, filed suit against
the city Tuesday. He asked Juneau Superior Court Judge Larry Weeks to
impose a temporary restraining order so the public could attend
meetings between the city and the North West CruiseShip Association. He
also asked that the meetings be in Juneau at a time and place
accessible to the public.

At a hearing Thursday afternoon, which lasted a little more than five
minutes, Weeks denied the request.

"On the facts presented here today, I don't think that people going
down to Canada under the circumstances that have been presented
constitutes a violation of the Open Meetings Act," he said.

Weeks said he might change his mind if Harris can show that the
meetings involve a government body, countering the city's claim that
they don't.

"Other than that, it's over," he told Harris.

Harris said this morning that he wasn't able find anything new to
dispute the city's arguments. While he was disappointed in the
decision, he said he was glad he went to court.

"I didn't undertake this lightly. I did this because I believe that
public business should be conducted in public," he said.

Financing for port projects and changes proposed for Steamship
Wharf-Marine Park are on the agenda of the Vancouver meeting. Both
items have generated controversy in Juneau over the past several weeks.

In court papers filed Thursday, City Attorney John Corso argued that
the group going to Vancouver isn't a government body and isn't subject
to the Open Meetings Act.

Although it is true that the Open Meetings Act covers the preliminary
stages of a decision, the city officials meeting with the cruise
industry have "no power to vote or reach consensus," he wrote.

"The threshold question is whether it is a government body. And a group
of people who lack the authority to take action by a group vote are not
a governmental body," Corso said.

The Open Meetings Act doesn't apply to gatherings of employees and
contains nothing to suggest city employees can't meet outside of
Juneau, he wrote.

Harris argued that the Open Meetings Act applies because the meetings
involve city funds and policy.

He cited a 2000 ruling in which retired Alaska Supreme Court Chief
Justice Jay Rabinowitz, now deceased, said the Open Meetings Act
applied to flightseeing noise mediation sessions in Juneau. The suit
was filed by the late Hugh Malone.

"It's not just the body, it's the decision process," Harris said.
"That's the heart of my argument. The same one that's used in the
Malone case."

Harris said it cost him about $150 to file the lawsuit. Corso said
Harris likely qualifies as a "public interest litigant" and probably
won't have to reimburse the city for the 15 hours it took him to
respond.

NO HE WOULD NOT. The people of that area have asked the cruise
lines to NOT enter the area because it IS their food source, and
the cruise lines have ignored them.

First white people stole their land. Then they destroyed their
culture and their economy. Now they stop them from hunting where
they have hunted for TEN THOUSAND YEARS.

The ****ing cruise ships should just leave them alone, like they
want. They don't want them and don't need them. They need the
seals and the fish, not ****ing gift shops.

And, yes, Mason, from your posts, it's obvious that you're a
racist who thinks that Native Americans should be living in the
15th century, and whose rights should be ignored.

It's only a matter of time before some hunter decides that he'll
shoot seals, ship or no ship, and someone gets hurt by a stray
bullet, and it will serve the racists running the cruise lines
and their racist passengers like you just right.

Dennis your frustration is showing. Heck, you can't even get the local
govt on your side so now you're resorting to profanity. Gotta love it!

BTW-Are you white? Maybe you should give back the homestead to the

yes, i am white. and i grew up with many tlingit and haida
people, and have learned to listen to what they say. i'm very
close to a number of my first nations friends and their families,
and i support many native causes.

when i hunt and fish, i share my catch with native elders who can
no longer do so. i visit them when they're sick, and honor them
in traditional ways when they die, and i've been honored in
return.

in other words, i don't think like most white people, and i
believe that i can only live here with the permission of the
native people, a permission which many of them have given me.

so you're barking up the wrong tree.
