Not saying this guy hadn't just had a swig, but if you are trying to set up a testing standard, you want to avoid "false positives" as much as you want to avoid false negatives. You have to set the level high enough so that you only "catch" folks who are truly imbibing and NOT tag folks who have random levels of alcohol in their blood stream. That said, I still would have thought that the number woulda been more like 0.02 or so. |

From the CA DMV website: "anyone under 21 found driving with a blood alcohol level of .01 percent or higher will automatically lose their driving privilege for one year." |

You are kidding, right? 3 glasses of wine in the first hour will take you to 0.05% according to most driver handbooks. You are not suggesting that some "traces" of alcohol will get you close to what probably 2-2.5 glasses of wine will get you do you? |

Well, if you read closely, you'll note I said I thought the number would be like 0.02. No, I wasn't trying to suggest that 0.04 would be based upon "traces". The suggestion was zero and that's extremely hard to achieve. 0.04 isn't all that hard either. You might not even feel it. |
