In a compromise move, the US is allowed to keep the data for
3.5 years but restrictions govern who can see it.


If anyone believes the USA will only keep the data for 3.5 years
or that the data will remain segregated, I have a bridge I want to
sell you. Pretty soon those passengers will start to receive credit
card pre-approvals in the mail because of the data. (how do I do
a smile with a grimace?)

Out of curiosity..

Does anyone know whether the converse applies? Will Airlines be obliged to
forward on (to EU countries) passenger data pertaining to US citizens
travelling to these countries?

Under most civilised country's laws, such forwarding is illegal, the EU
included. The EU was blackmailed into waiving its data privacy laws to please
the Bush regime's thirst for personal data.

I suspect it is only a matter of time before someone takes EU airlines to
court over the illegal transmittal of data and the european court will find
that the EU constitution prohibits such exchcnages and will hence invalidate
the deal the EU government agreed to make. This will probably happen after the
Bush regime has been ousted and its replacement will not make a big fuss about
things returning to normal.
