Default Surcharge

I have heard rumors that the new $5 fuel surcharge may be illegal.
Anyone have more information on that rumor?

If you are a Canadian and booked with a Canadian TA then you have a
contract that, under law in many provinces, cannot be altered. That is
why RCI added this to their surcharge information:

*For Canadian reservations, the fuel supplement only applies to
reservations made on or after November 16, 2007, for sailings that
depart on or after February 1, 2008.*

I can't speak of other countries except to say that US residents do not
get this break unfortunately.

The US contract specifically allows the surcharge, by name.

I've only had one Candian client book a cruise, so I have no idea what
their contracts look like. Except that they were shorter.

Are you sure that was the case pre-11/16? Someone on CC pointed
out that the Celebrity (and presumably RCI as well) agreement
was changed on that date and prior to that only allowed them to
add government taxes and fees. I also discovered that they
agreed to refund the surcharge to people who paid on 11/16 after
it was imposed. I had checked with my TA on that date and he
said it was already added onto the bill so I didn't bother
paying. Others called Celebrity and were told it was too late so
they did not pay.

I sent email to Celebrity and pointed out the issues with the
agreement and the fact that they were refunding it for 11/16
payments and asked them to refund mine as well. They sent back a
form letter saying they were collecting all comments and would
respond soon. It's been a few weeks now and no one has heard
anything.

Other lines are obviously different.
