You are very confused. I post press releases. They are NOT
copyrighted and ARE intended by the publishers to be distributed. You
are posting copyrighted material which is the publisher/writer's
property. I & Marco post a link to the copyrighted material. There
is a big difference in that you violate a copyright and I do not.

Technically they ARE copyrighted, under US Law. However, with press

is waived. I know I am anal retentive about this.. sorry.


Berne Convention. In fact, anything "published" is copyright
protected. That view has been held to the extent that posts to the
Internet (like this one) appear to be protected. But quotation with
proper citation for purposes of commentary, review or editorial in
nature are permitted. So you can quote me and filet me, but only with
attribution. You can't go off and just republish my comments.

There is no proper way to post an entire copyrighted article without
permission from the copyright holder. In this case the Los Angelos
Times. If they gave permission then they would want credit for the
author and the publication.

If you see an interesting article, if they have published it to their
website, you what you can do is post a link to the article. That is you
can post the url the Newsgroup.

The information can be provided without violating copyright. Posting
the link (url) to the article. Copying the article is wrong. The sleeze
not only copied the article, he lied about getting it from the trades
and gave no attibution to the source or credit to the author.

He is also violating the Acceptable Use Policy of his ISP.
From the Earthlink AUP:

Probably every ISP has the same policy. I would hate to see anyone lose
their account or get in trouble with the law because they want to
provide information when they can simply do it right by posting an url.
Some people don't know about copyright or their ISP'S policies. I think
it is good to remind everyone in the newsgroup so they don't do it out
of ignorance.The info can still be provided by posting the url.

Sisker is not doing it out of ignorance, he is a spammer and a sleeze.

Not a big Sisker fan, but if he is actually getting the stories from
an actual trade source, he may NOT be able to link to them without
giving you his ID & password.

Just because something is published in the Tampa Bay Penny Saver
doesn't mean that it was the ONLY place that it was published. Many
stories go out over the wires, are syndicated, or are distributed via
other means to publications throughout the world.

You should not believe Sisker's mumbo jumbo claims about where he got
it unless he proves it.

In any case even if a story goes over the "wires" or is syndicated or
reprinted, it still requires permission and an attribution of the
origional source to copy it.

My dad was the only lawyer in the family so I'll ask you.

Are you saying that any time we answer your post and quote you we are only
legally correct if we show that you were the person who wrote the original
note?

Most of which are covered by copyright no matter how they are
distributed. Associated Press, for instance, copyrihgts everything and
then licenses its use to their members. Same for most syndicates, etc.

That is my understanding. However, enforcement is another issue.

BUT, I know of at least one complaint that was settled out of court
involving Deja News and the archiving of Usenet posts.

Deja was based in Austin. I have all sorts of juicy stuff about them,
I was project manager for a development project that never was fully
developed.

favorite travel agent. ;+)
